A. Notwithstanding any contrary provision in this chapter, the city shall not authorize a dispensary to deliver cannabis if the dispensary is located or is proposed to be located in the southeast industrial area and there are 50 or more dispensaries authorized to deliver that are located in the area.
B. Whenever the number of valid permits for dispensaries authorized to deliver is less than 50, the city manager may issue another available permit through a process that is established by city council resolution. The process must, at a minimum, be consistent with this code and may:
1. Evaluate whether applicants will be able to successfully submit a complete application for a permit for a dispensary authorized to deliver;
2. Evaluate whether applicants will be able to successfully operate a dispensary; and
3. Utilize criteria reasonably necessary to protect the public health, safety, and welfare. (Ord. 2021-0017 § 1)
