5.150.235   Call-up review of cannabis business permit issuance.
   If the city manager issues a cannabis business permit for a business that does not require a conditional use permit pursuant to article IX of chapter 17.228, the following procedure applies:
   A.   Notice to city council. As soon as reasonably practicable after the city manager issues the cannabis business permit, the city manager shall report that decision to the city council by sending the report by electronic mail and confirming that each member of the city council received it.
   B.   Procedures for call-up review. The mayor or the councilmember in whose district the business is located may call up for city council review the decision by filing a written request with the city manager within 15 business days of the city manager's decision. Once the request is filed, the council shall notice and set the matter for hearing before it. Notice of the hearing shall be given in the manner provided in section 17.812.010.A.2.a. The city council shall hear the matter in the same manner that the city manager heard the matter.
   C.   Withdrawal of request for review. The requester under subsection B may withdraw that request. The withdrawal shall be noted on the next regularly scheduled meeting of the city council and shall be considered to have occurred on that date. Any other member of the city council shall have 10 days thereafter to file a request for call-up review. If the tenth day is a non-business day, the last day to file the request is the next business day. Noticing and consideration of the matter shall be as set forth in subsection B. (Ord. 2017-0057 § 3)
