5.124.240   Grounds for denial of a massage therapy establishment permit.
   The city manager may deny a massage therapy establishment permit if the city manager determines that one or more of the following circumstances exist:
   A.   The application received is incomplete or filed late;
   B.   The application contains a false or misleading statement or omission of a material fact;
   C.   The applicant has unpaid city fines, penalties, or business operations taxes;
   D.   The applicant poses a threat to the public health, safety, or welfare;
   E.   Within five years of filing the application, the proposed site is or has been the subject of a pending investigation or administrative penalty, or of a suspension or revocation of a massage therapy establishment permit; or
   F.   Within 12 months of filing the application, the applicant, any registered owner, or any person with a financial interest in the massage therapy establishment has had a massage therapy establishment permit denied for any of the reasons provided in subsections B through E or has had an establishment permit revoked.
