A franchisee shall, if practical, install its cable television system at the time the public improvements are being installed with respect to any territory within service areas for which an application has been filed by the time the franchise is issued to subdivide the territory into five or more lots for residential purposes. In any event, basic service and other services identified pursuant to the provisions of Section 5.28.1280 of this chapter and in Article VI of this chapter, shall be made available to all lots within such territory the subdivision of which has been completed not later than fifty-one (51) months following the date of filing of the certificate of acceptance of the franchise pursuant to the provisions of Section 5.28.440 of this chapter.
With respect to all territories within service areas for which application for approval of a tentative map for such subdivision purposes is made after issuance of the franchise, the franchisee shall install its cable television system at the time the public improvements for the subdivision are being installed. Basic service and other services identified pursuant to the provisions of Section 5.28.1280 of this chapter and in Article VI of this chapter, shall be made available to each lot within such subdivisions not later than the date of occupancy of each dwelling unit, or fifty-one (51) months following the date of filing of the certificate of acceptance of the franchise pursuant to the provisions of Section 5.28.440 of this chapter, whichever occurs later.
