Not later than one year after a request for renewal is filed, the board of directors of the cable television commission shall decide whether renewal of the franchise will be offered to the franchisee. Decision as to whether renewal will be offered to the franchisee, shall, except as provided by Section 5.28.530 of this chapter, be vested within the sole discretion of the board of directors of the commission, shall be made on the basis of such factors or criteria as the board of directors of the commission may in its discretion elect, and upon such terms, conditions or requirements as the board of directors in its discretion may prescribe.
If the board of directors of the commission fails to decide whether to offer renewal of the franchise to the franchisee within the time prescribed above, the request for renewal shall be deemed denied and the franchise shall terminate at the expiration of its terms. (Prior code § 20.03.232)
