2-4-13: CONSTRUCTION STANDARDS:
The franchisee shall meet the following construction standards:
   A.   All construction and maintenance of the franchisee, including installation, shall conform to the national electric safety code, national electrical code, Bell System code of pole line construction, the statutes of the state and ordinances of the city. The franchisee shall provide the city with a map designating the location of cable television facilities, and said map shall be available for public inspection.
   B.   All transmission and distribution structures, lines and equipment erected by the franchisee within the city shall be so located as to cause minimum interference with the proper use of streets, alleys and other public ways and places and to cause minimum interference with the right and reasonable convenience of property owners who adjoin any of the said streets, alleys or other public ways and places. All cables and wires shall be installed, where possible, parallel with electric and telephone wires. Unless engineering considerations dictate to the contrary, multiple cable configurations shall be arranged in parallel and bundled.
   C.   In case of any disturbance of pavement, sidewalk, driveway or any other surfacing, franchisee shall, at its own cost and expense, and in a manner approved by the city engineer, replace and restore all such disturbed areas in as good a condition as before said work was commenced and shall exercise reasonable care to maintain the same thereafter in good condition for a period of one year. Franchisee shall not be required to pay a fee for street openings.
   D.   In the event that at any time during the period of this franchise the city shall lawfully elect to alter or change the grade of any street, alley or other public way, the franchisee, upon reasonable notice by the city, shall remove, relay and relocate its poles, wires, cables, underground conduits, manholes, and other fixtures at its own expense in locations to be approved by the city engineer.
   E.   The franchisee shall, on the request of any person holding a building moving permit issued by the city, or any person who wishes to remove trees or structures from their property, temporarily raise or move its wires to permit the moving of buildings or tree removal. The expense of same shall be paid by the person requesting same, and the franchisee shall have authority to require payment in advance and not less than forty eight (48) hours' notice in advance.    F.   The franchisee shall have the authority to trim trees upon and overhanging the streets, alleys, sidewalks, and public places of the city so as to prevent the branches of such trees from coming in contact with the wires and cable of the franchisee; all such trimming to be done with the approval of and under the supervision of the city council and at the expense of the franchisee.    G.   In all sections of the city where the city designates an area where all aboveground services are to be placed underground, the franchisee shall place its wires underground on the same time schedule and on the same conditions that are applicable to the providing of other aboveground services in the designated areas.
