A. Whereas:
1. The city of Sabin and Elmwood Township have entered into a joint powers agreement dated June 8, 1982, for the purpose of jointly coordinating and controlling a cable TV franchise; and
2. The city council of Sabin did on June 28, 1982, adopt a resolution to remove itself with respect to cable television systems from the provisions of Minnesota statutes chapter 238, as authorized by chapter 514, Minnesota laws 1982; and
3. The franchisor, after consideration, analysis and deliberation, has approved and found sufficient the technical ability, financial condition, legal qualification and character of said franchisee; and
4. The said franchisor has considered and analyzed the plans of the franchisee for the operation of the cable communications system and found the same to be adequate and feasible in view of the need and requirements of the entire area to be served by the said system; and
5. To the knowledge and belief of the franchisor, this franchise and the procedure used in formulating and awarding the same in all things and in all ways complies with the laws of Minnesota.
B. Now, therefore, there is hereby granted by the city to the franchisee and to its successors, assigns or designees the nonexclusive franchise and right to erect, maintain and operate in, under, over, along, across and upon the present and future streets, lanes, avenues, sidewalks, alleys, bridges, highways, easements dedicated for compatible uses, and other public places in the city and subsequent additions thereto, towers, poles, lines, cables, wires, manholes and all other fixtures and equipment necessary for the maintenance and operation in the city of a cable television system, for the purpose of transmission and distribution of audio, visual, electronic and electric impulses in order to furnish television and radio programs and various other communications services to the public by what is commonly called a community antenna television system, for a period ending June 1, 2000, commencing from and after the effective date hereof; provided, however, that the franchise shall be subject to the terms and conditions stated herein.
