5-1-3: WINTER PARKING:
   A.   Days And Hours Restricted: It shall be unlawful for any person, company, or corporation to park any kind of vehicle or object upon any streets of the city between the dates of November 1 and April 15, between the hours of one o'clock (1:00) A.M. and seven o'clock (7:00) A.M.
   B.   Impoundment, Redemption And Disposition Of Vehicles: After an attempt has been made to contact the owner of the vehicle or object, Clay County law enforcement personnel or the mayor of the city (or in the mayor's absence, the acting mayor) may have vehicles or objects removed from a street to a place of safety when the vehicle or object is parked in violation of this section. Such vehicle or object shall not be released until towing and storage fees are paid in addition to any fine imposed for violation of this section. Prior to the release of any vehicle or object impounded pursuant to this section, the person seeking the release thereof shall furnish evidence of ownership sufficient to indicate that he or she has the right to possession of the vehicle or object. Vehicles or objects which are not redeemed within fifteen (15) days will be considered abandoned and shall be disposed of in accordance with Minnesota statutes sections 168B.01 through 168B.11.
   C.   Prima Facie Evidence: The presence of any motor vehicle or object on any street when standing or parked in violation of this section is prima facie evidence that the registered owner of the vehicle or object committed or authorized the commission of the violation.
   D.   Violation; Penalty: A violation of this section is a petty misdemeanor unless it is committed in a manner and under circumstances so as to endanger any person or property, and in that event, it shall be a misdemeanor. Punishment shall be as prescribed by the statutes of the state for a petty misdemeanor or misdemeanor, as the case may be. (Ord. 225, 12-19-2000)
