§ 95.23 EXCAVATION FILL REQUIREMENTS AND PROCEDURES.
   (A)   Any person, firm or corporation digging, excavating or tunneling through or under any of the city streets, alleys, pavements, or other public property pursuant to this chapter will if it be a street, alley, or sidewalk haul all soil away from the excavation and use crushed stone back fill such as pit run gravel or #73 stone. The immediate area shall be swept clean before leaving the site.
   (B)   All openings in thoroughfare surface must first be sawcut to obtain a straight edge for proper repair.
   (C)   All backfill must be crushed stone, size #73's unless otherwise specified.
   (D)   Backfill will be compacted every four inches and covered with a minimum of four-inch concrete and concrete will be covered with a minimum of one and one-half-inch asphalt. Asphalt will be hot-mix variety unless weather permits, in such case, a cold patch mix will be allowed temporarily and must be replaced with hot-mix as soon as possible.
   (E)   Upon inspection, by the Street Commissioner, and after determining all repairs are satisfactory , the Street Commissioner shall file his or her approval or disapproval with the Clerk-Treasurer and the year warranty period shall begin.
   (F)   Any contractor or owner will be charged for repairs and expenses associated with any application for future permits if the contractor or owner fails to repair the problem.
   (G)   Anyone issued a permit will be responsible for maintaining the opening for a period of 60 days after closing.
   (H)   Any public utility company required to dig in the street, alley, or thoroughfare for maintenance of installation, or services are hereby granted an option in lieu of payment of fees to provide bond as fixed by this chapter, to resurface all openings in streets, alleys, sidewalks or thoroughfares made by the public utility company; and the sub-surfacing and resurfacing of the streets, alleys, sidewalks or thoroughfares shall have all spoil hauled away.
   (I)   The Wastewater Superintendent shall be notified by the applicant before starting work and after payment of the permit fee. The applicant shall comply with Title V of the Code of Ordinances of the City of Rushville.
   (J)   All surfacing of the openings dug shall be subject to the final inspection and approval by the Street Commissioner.
