(A) Between the hours of 8:00 a.m. and 6:00 p.m. Monday through Saturday, no vehicle shall park in a municipally owned parking lot or within the right-of-way of a city street or alley, or in an area designated for customer/visitor parking unless the driver's or passenger's primary purpose for parking in the designated area is to purchase or look to purchase goods or services from the surrounding businesses, or to visit a governmental office, museum or conduct other business in the area.
(1) DOWNTOWN PARKING AREA is defined as:
(a) East and west sides of Main Street, Indiana State Road Three, extending south from the railroad tracks to Flatrock River;
(b) East and west sides of North Perkins Street extending from Third Street to Water Street;
(c) East and west sides of North Morgan Street extending from Third Street to Water Street;
(d) North and south sides of Third Street extending from Perkins Street to Morgan Street and extending on the north side of Third Street from the southeast corner of the property upon which the U.S. Post Office is located continuing adjacent to the U.S. Post Office property on the east side of North Harrison Street;
(e) North and south sides of Second Street to North Harrison Street with the exception of the two houses on north side of the street between North Morgan and Caldwell Avenue;
(f) North and south sides of West First Street extending from Harrison Street to Julian Street; and
(g) North and south sides of the street extending from North Morgan Street to North Perkins Street.
(2) CUSTOMER/VISITOR PARKING is delineated by signage.
(B) Customer/visitor parking spaces are available for the primary use vehicle of employees, lessees or owners of the area businesses regardless of whether they purchase goods or services. Parking is available to the primary use vehicle of downtown residents located in the designated area if the owner of the building lives or leases the upstairs as a living space to persons identified as the owner or tenant.
(C) The spaces reserved for customer/visitor parking shall be designated by posting signs designating the space for customer/visitor parking only. The sign shall be clearly visible to a driver of a vehicle parking in the designated space and shall clearly designate the space for customer/visitor parking only. The customer/visitor parking areas may be designated within the downtown parking area.
(D) Parking shall be limited to a two-hour time limit on Main Street (State Road 3 North) between 2nd Street and 4th Street.
(E) When municipal lots are being utilized for designated events, parking shall be prohibited during those events.
(F) It shall be unlawful for the operator of any vehicle to stand or park such vehicle in a municipally owned parking lot or in any other area where signage prohibits within the Downtown Business Area of the City of Rushville between the hours of 4:00 a.m. and 5:00 a.m. unless said operator resides in the Downtown Business Area.
(G) Anyone in violation of this section shall be penalized pursuant to § 71.99.
