(A) The City Council has determined that in each public parking facility in the city that has a total number of parking places from 51 to 75, at leastthree spaces, nearest the street, shall be reserved for the parking of vehicles owned or operated by a handicapped person as defined by Indiana Code with a properly marked vehicle pursuant to Indiana Code; that each space so designated shall be clearly marked immediately adjacent to and visible from the place assigned bearing the official international wheelchair symbol and a notice of the penalty for violating this chapter. The penalty shall be in accordance with the penalties set forth in § 71.99.
(B) On-street handicapped parking spaces in residential areas are available only to a resident who has requested the parking space and has the proper handicapped person placard on their vehicle. The request shall be made of the office of the Street Commissioner, who shall have the authority, personally or through a designee, to approve or disapprove said request upon performing a proper inspection. Such request must be renewed on an annual basis, and if it is not renewed on an annual basis, the sign will be removed. Furthermore, all previous signs for handicapped parking shall be grandfathered in and only removed upon notification to the property owner adjoining the public street where the sign is located and that property owner's agreement to move it.
(C) Disabled veteran parking.
(1) For the purpose of this section, a disabled veteran shall be identified as an individual certified to be a disabled veteran by the State Department of Veteran's Affairs with a vehicle bearing a valid disabled hoosier veteran license plate, or out-of-state equivalent registration plate.
(2) By ordinance, there is one authorized disabled veteran parking place granted to the American Legion Post 150, located at 219 N. Perkins Street, Rushville, Indiana 46173. The disabled veteran parking stall shall be located adjacent to the front door of the establishment along the curb of the southbound lane. This parking place shall be further codified in Chapter 73: Parking Schedules under Schedule IV, Handicapped Parking.
(3) The penalty for violation of this section shall be in accordance with penalties set forth in § 71.99.
