§ 53.50 ADMINISTRATION BY BOARD OF WORKS.
   (A)   The sewer works shall be administered by the Board of Works, established in and hereinafter referred to as the Board. The Board shall have general management responsibility for the staffing and operations of the sewer works. By resolution of the Board, recommendations to the City Council concerning rates, extensions, improvements and expansions shall be offered.
   (B)   The Board of Works shall make and enforce such by-laws and regulations as maybe deemed necessary for the safe, economical and efficient management of the city sewerage system, regulator chambers, pumping station and sewage treatment works, for the construction and use of house sewers and connections to the sewerage system, and for the regulations, collection, rebating, and refunding of such rates and charges.
   (C)   The Board of Works is hereby authorized to prohibit dumping of wastes into the city sewerage system, which, in its discretion, are deemed harmful to the operation of the sewage treatment works of the city or to require methods affecting pretreatment of the wastes to reduce the characteristics of the waste satisfactorily to the city.
   (D)   Pursuant to I.C. 8-1.5-4-2, the composition of the Board of Works shall be as follows:
      (1)   The Board shall consist of five members;
      (2)   A majority of the members shall be appointed by the Mayor and a minority of the members shall be appointed by the City Council;
      (3)   The terms of the members shall not exceed four years;
      (4)   The salaries of Board of Works members shall be established by the City Council;
      (5)   The Board of Works shall select the Chair of the Board of Works who is not the Department Head for purposes of I.C. 36-4-9-2;
      (6)   Not more than two-thirds of the members may be of the same political party.
   (E)   The Board of Works shall have all powers set forth in I.C. 8-1.5-4-2.
   (F)   Any storm water drainage in the storm sewer system shall be administered by the Board of Works.
