§ 32.02 STATUTORY BOARDS AND COMMISSIONS.
   (A)   Department of Parks and Recreation. There is hereby established a Department of Parks and Recreation to be controlled and operated by the Park and Recreation Board established pursuant to I.C. 36-10-3 and having the power, duties and responsibilities as set forth therein.

   (B)   Department of Economic Development. There is hereby established a Department of Economic Development consisting of the Economic Development Commission organized under I.C. 36-7-12 and having the powers, duties and responsibilities as set forth therein.

   (C)   Board of Works. The Board of Works of the City of Rushville, Indiana shall replace the Utility Service Board and said Board shall have all of the powers and duties previously vested in the Utility Service Board by I.C. 8-1.5-3-1 through I.C. 8-1.5-3-15 and the control of all utilities owned by the City of Rushville including but not limited to the Sewage and Water Works of the City is hereby vested in said Board.
      (1)   The Board of Works shall have all powers and duties vested by I.C. 8-1.5-3-1 et seq. and the Board shall operate, manage, and have the supervision and control of all municipally owned utilities owned by the City of Rushville including but not limited to the Water Works, and Sewage of the City is hereby vested in said Board.
      (2)   All resolutions and actions of the Utility Service Board done prior to Ordinance 2021-15, including but not limited to any and all bond anticipation notes and other financing, the application for and receipt of grants, as well as any and all ongoing projects, contracts, and any other business shall be assumed by the Board of Works and all Utility Service Board Funds shall continue to be managed by the Clerk-Treasurer of the City of Rushville.
      (3)   The contractual and supervisory personnel now employed by the Utility Service Board shall hereafter be employed by the Board of Works and their duties and salaries shall remain the same except for the changes made by this division (C).
      (4)   In dealing with the duties of the operation of the Municipal Utilities owned by the City of Rushville, Indiana, the Board of Works may employ an attorney and other professional assistance needed to manage the affairs of the Municipal Utilities including the Clerk-Treasurer of the City of Rushville, Indiana.

   (D)   Area Plan Commission of Rush County. The city elects to become a participating member of the Area Plan Commission of Rush County as established by Chapter 138, Acts of the 1957 General Assembly and having the power, duties and responsibilities as set forth therein.

   (E)   Rush County Redevelopment Commission. The city elects to become a participating member of the Rush County Redevelopment Commission and shall participate in performing prescribed duties and responsibilities as set forth by state and federal law.
