(A) The city Street Department or an agent acting on its behalf, will issue all serial numbered city trash toters, and shall be the responsible city agency for all toter operation and maintenance functions.
(B) It is the responsibility of the city resident to maintain the city issued trash toter in good functioning condition, void of loose debris and trash, and free from neglect and utilized for its intended use.
(C) City residents shall report all damages and requests for toter maintenance to the city Street Department.
(D) Once received, the city Street Department will, at no cost to the resident, remove and replace any broken toter components or an entire toter at no charge to city residents as long as damages are not the result of resident negligence or maleficence, and the damages or component failure(s) are a result of normal usage and wear, as defined by the city Code Compliance Officer.
