The chief of the fire department shall have the power to appoint a competent member of the department to act as assistant chief of the fire department. The assistant chief shall perform those duties assigned to him by the chief, and shall, in the absence of the chief, perform the duties and have the powers of the chief. (1960 Code, Sec. 1-703)
The duty of extinguishing fires, preventing the spread of fires, preventing fires and protecting life and property from fire, within the city, and the power to do all things reasonably necessary for the performance of those duties, shall be and hereby are entrusted to the chief of the fire department. In addition, the chief shall perform those duties and exercise those powers otherwise provided in this code or assigned to him by the mayor and council. The chief shall have full control over the fire department and its members and equipment at all times, subject, however, to the approval of the mayor and city council. (1960 Code, Sec. 1-704)
Whenever a fire shall occur, it shall be lawful for the chief, or other officer in command, to blockade any street, avenue, alley, sidewalk or other place, if in his judgment it is necessary to ensure the efficient working of the department or to protect equipment of the department or to protect persons from injury. (1960 Code, Sec. 1-705)
The chief shall receive as compensation a salary per month as is fixed by the mayor and council from time to time, and each member of the department shall receive such compensation as is fixed by the mayor and council from time to time by resolution. No compensation shall be paid in event of false alarms or where there is no need of the department to extinguish the fire. (1960 Code, Sec. 1-706; amd. 1977 Code)
All sums for the purposes of this chapter shall be paid out of any monies in the general funds of the city immediately after being approved by the mayor and council at any regular meeting or special meeting called for that purpose.
Provision shall be made at the time of making the regular city tax levies to meet the requirements of this chapter. (1960 Code, Sec. 1-706)
