§ 94.38 CLAIMING IMPOUNDED DOGS.
   If any person owning or having custody of any dog so impounded which has been licensed pursuant to the Act under a valid subsisting license, shall, within 72 hours after the impounding of the dog, apply to the Police Chief for the release of the dog, and pay to the Village Treasurer an impounding fee of $5, the Police Chief of the village shall surrender the dog to the owner or person having had custody thereof. Otherwise, upon the expiration of the 72 hours, the Police Chief shall surrender the dog to the Sheriff of the County of Oceana, or any member of the state’s constabulary, or make other disposition pursuant to the Act; provided, in the event a complaint shall have been made by any person pursuant to § 26-A of the Act, being M.C.L.A. § 287.280, and knowledge of the complaint shall be communicated to the Police Chief, the dog shall be restrained in the village dog pound until the disposition of the complaint, subject to the orders of the court having jurisdiction of the complaint.
