§ 72.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   HIGHWAY or STREET. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
   OPERATE. To ride in or on, and to control the operation of, a snowmobile.
   OPERATOR. Any person who operates, or is in actual physical control of, a snowmobile.
   OWNER. Any person, other than a lien-holder having property in, or title to, a snowmobile, entitled to the use or possession thereof.
   PERSON. An individual, partnership, corporation, the state, or any of its agencies or subdivisions, and any body of persons, whether incorporated or not.
   RIGHT-OF-WAY. The portion of the highway less the roadway and any shoulder.
   ROADWAY. The portion of a highway improved, designated, or ordinarily used for vehicular travel.
   SHOULDER. The portion of a highway on either side of the roadway which is normally snow plowed for the safety and convenience of vehicular traffic.
   SNOWMOBILE. Any motorized vehicle designed for travel primarily on snow or ice steered by wheels, skis, or runners.

§ 72.02 REGISTRATION.
   Except as otherwise provided, no snowmobile shall be operated within the village unless registered by the owner, as provided by Public Act 451 of 1994, being M.C.L.A. §§ 324.82101 through 324.82160. No registration is required for a snowmobile operated exclusively on lands owned, or under the control of, the snowmobile owner.

§ 72.03 OPERATION WITHIN VILLAGE LIMITS.
   No person shall operate a snowmobile in the village:
   (A)   At a rate of speed greater than is reasonable and proper having due regard for conditions then existing;
   (B)   While under the influence of intoxicating liquor or narcotic drugs, barbital, or any derivative of barbital;
   (C)   In, or on, any property, park, or playground in the village, nor in any nursery, planting area, or natural area of forest owned by the village, except by permit and permission granted by the Village Council first obtained;
   (D)   On a highway, street, or public sidewalk in the village, except for travel upon the right-of-way of a highway, street, or public sidewalk when traveling single file, parallel to motor vehicle traffic upon the street, and at a speed not greater than the minimum required to maintain forward movement of the snowmobile;
   (E)   During the hours from one-half hour after sunset to one-half hour before sunrise without displaying a lighted headlight and a lighted taillight, or under any conditions where the absence of the lights would be unsafe;
   (F)   Unless equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smoke. Excessive noise shall specifically include unnecessary racing or accelerating of the engine; or
   (G)   On any private property within the village limits without the prior consent or permission of the owner or occupant of the property, except that an arrest under this section shall be subject to the occupant or owner filing a sworn complaint prior to arrest.
