§ 130.01  DEBRIS CONTROL.
   (A)   (1)   Any person constructing a new structure, or, when deemed altering or repairing any existing structures, shall commit to the Clerk-Treasurer in writing the maintenance and use of a covered debris container the minimum of two cubic yards, which container shall be located on the job site at all times construction is in progress.
      (2)   The person shall ensure that the debris container is regularly emptied and maintained, that debris shall not escape the property, and that the property is maintained in a suitable manner to protect and sustain the appearance of the property and surrounding properties.
   (B)   No person constructing a new structure, or, when deemed altering or repairing any existing structures, shall allow vehicles of any type to track onto, carry, or transfer any debris, including mud or earth, onto the traveled portion of any street or alley within the town and shall further erect erosion control barriers to prevent erosion of the construction site onto adjoining streets, alleys, or properties.
   (C)   For this section, a PERSON shall be defined as any person or entity in possession of a building permit for the construction, altering, or repairing of any structure. The CONSTRUCTION PERIOD shall be defined as the period of time for which the building permit is issued.
