§ 91.02  PARK FEES.
   (A)   The town, through its Clerk-Treasurer, Town Marshal’s office, or any other agent of the town, shall charge individuals or organizations desiring to use a shelter house and/or specific areas of the park pursuant to the fees listed below:

   (B)   If the state sales tax rate increases, the town’s tax charged shall increase accordingly without further amendment of this chapter. Individuals/organizations may be subject to a damage deposit/key deposit/cleaning deposit in addition to the fees outlined herein. The town reserves the right to waive such rental fees in whole or in part.
   (C)   At the time of renting, a person or organization shall tender to the Clerk-Treasurer the entire applicable rental fee to be held by the Clerk-Treasurer. If a person or organization notifies the Clerk-Treasurer more than 90 days before its use of its intent to cancel its reservation, the prepayment shall be refunded in full. If the Clerk-Treasurer is notified less than 90 days prior to the shelter use, the above prepayment shall not be refunded.
   (D)   A day shall include any period of time on a given day between the hours of operation as outlined in § 91.01.
   (E)   Any individual or organization desiring to use a shelter house and/or specific area of the park shall comply with all federal, state, and local government requirements and regulations, including, but not limited to, filing for all necessary permits, paying all necessary permit fees, filing with the appropriate agency a Form 42235 application for amusement entertainment permit or like form, and preparing a contingency plan and site drawing. Additionally, if required by the town, an individual or organization shall provide proof of insurance to cover its usage of a shelter house and/or specific area of the park.
