If the applicant fails or refuses to restore the surface to a satisfactory condition or fails to remove all excess materials within a reasonable time, the City may proceed to make the restoration and remove the material and the deposit referred to in Section 901.02 shall be deemed forfeited. Thereupon, this deposit shall be paid into the Street Maintenance, Construction, and Repair Fund. If the cost of restoration is greater than the amount of the deposit, the Clerk of Council shall proceed to collect the balance due from the applicant.
