§ 153.15 IMPROVEMENTS.
   (A)   Generally. Prior to approval of the final plat, the following improvements shall be installed, bonded for, or otherwise guaranteed according to § 153.27. The subdivider or developer shall assume the entire cost of all improvements, whether they be sewer line extensions or street paving, listed in this section. Any professional service required in this chapter as a condition of approval of a subdivision plat, such as soil percolation tests, shall be also paid for by the subdivider.
   (B)   General improvement requirements. All proposed subdivisions located within the subdivision territorial jurisdiction of the town shall comply with the following improvement requirements. Permanent monuments shall be placed at the intersection of all street center lines, all points of curvature of street center lines, all points of tangency of street center lines, and at all change of direction of street center lines in the event that a curve is not used. Where above street center line location for monuments are impractical due to existing water and/or sewer lines or due to the existence of other physical objects off-set reference monuments to the above points may be placed within the street right-of-way at the locations as are practical with adequate measurements being shown on the final plat for the location of the street center line from these monuments. It is intended that these monuments shall be placed at such a location as to avoid destruction by maintenance of water and sewer lines. It is recommended that they be placed at least five feet from existing water or sewer lines and it is recommended that, if possible, all off-set monuments be placed on the same side of the street center line for the purpose of leaving as much of the street right-of-way as is possible for water or sewer lines or other utility lines. All monuments within the street rights-of-way are to be buried so that the top of the monument is a minimum of one and two-tenths feet below finished street grade elevation. It is recommended that the town place prior to the paving of streets a metal casting and cap necessary for access to these monuments. It is required by the town that within an area of a five-foot radius around each monument shall not be disturbed by installation or maintenance of any utility, road construction crews, contractors’ construction crews, or utility company crews. In addition to the above street center line monuments, a monument shall also be placed at all corners at turns in the exterior boundary of the subdivision (these monuments may project above the ground and inaccessible turns in boundary lines shall be referenced by off-set monuments) and at the other points as may be necessary to make the retracing of the lines as shown upon the final plat thereof reasonably convenient. The location of all the monuments shall be clearly designated on the final plat. All lot corners shall be marked by permanent markers or monuments.
   (C)   Streets.
      (1)   All streets shall be cleared and graded so as to provide adequate shoulders and pedestrian walk-ways. Finished grades, cross-section, and profile shall be in accordance with the current minimum construction standards of the State Division of Highways for subdivision roads.
      (2)   All street subgrade and/or base materials and the placement of these materials shall meet the current minimum construction standards of the State Division of Highways for subdivision roads.
      (3)   Streets shall be paved in accordance with the current minimum construction standards of the State Division of Highways for subdivision roads.
   (D)   Surface water drainage.
      (1)   No surface water drainage shall empty into a sanitary sewer.
      (2)   Where, in the opinion of the Planning Board, a public storm water sewer is reasonably accessible, before a subdivision is approved and accepted by the town, the subdivider shall connect with the public storm sewer system by providing all grading and all structures necessary to carry the water to the storm drainage system. Drainage and construction of drainage structures shall conform to town specifications and standards.
      (3)   Where a storm drainage system is not accessible, before a subdivision is approved and accepted by the town, the subdivider shall do all grading and provide all drainage structures necessary to properly carry the water to locations which are acceptable to the town.
      (4)   Where drainage ditches are provided and grades exceed 4%, the ditches shall be paved in accordance with the town standards.
   (E)   Sidewalks. Sidewalks shall be constructed on the street right-of-way and installed in accordance with the following policy wherever the Planning Board deems necessary.
      (1)   Sidewalks shall be constructed on all streets located within a one-half mile radius of all public schools provided that these streets are likely to be used by children in walking to school.
      (2)   Sidewalks shall be required on major streets and retail commercial streets where considerable pedestrian traffic is expected, and may be required on other streets where deemed necessary by the Planning Board.
      (3)   In those cases where sidewalks are required, they shall be constructed on both sides of the street.
   (F)   Street trees. Although not required by these regulations, the planting of street trees is considered a duty of the subdivider, as well as good business practice. Street trees are a protection against excessive heat and glare and enhance the attractiveness and value of property. Trees shall be planted inside the property lines where they are less subject to injury, decrease the chance of motor accidents, and enjoy more favorable conditions for growth.
