(A) Whenever any vehicle is operated in violation of § 93.36, the owner or driver of the vehicle shall be deemed guilty of the violation, and either the owner or the driver of the vehicle may be prosecuted for the violation.
(B) Any person, firm, or corporation convicted of any violation of § 93.36 hereof shall be fined according to the following schedule:

From 2,001 pounds through 2,500 pounds overweight | $135 |
From 2,501 pounds through 3,000 pounds overweight | $165 |
From 3,001 pounds through 3,500 pounds overweight | $260 |
From 3,501 pounds through 4,000 pounds overweight | $300 |
From 4,001 pounds through 4,500 pounds overweight | $425 |
From 4,501 pounds through 5,000 pounds overweight | $475 |
From 5,001 or more pounds overweight | The fine shall be computed at the rate of $75 for each increment of 500 pounds overweight or fractions thereof |
(C) All fines and penalties recovered under the above provisions shall be paid to the Village Treasurer and be deposited in the Village Street Fund.
