§ 91.015  ADOPTED.
   (A)   It shall be unlawful for any person to violate this section, to permit or maintain such violation, to refuse to obey any provision thereof, or fail or refuse to comply with any such provision or regulation except as variation may be allowed by action of the Chief of the Harlem Roscoe Fire Department in writing, and proof of such unlawful act or failure to act shall be deemed prima facie evidence that such act is that of the owner. Prosecution or lack thereof of either the owner or the occupant shall not be deemed to relieve the other.
   (B)   The provisions of this section shall apply equally to both public and private property. It shall apply to all new structures and their occupancies including buildings, structures, equipment, and, except as otherwise specified within its own terms, to existing structures and their occupancies, including buildings, structures, and equipment that constitute a clear and present hazard to life or property.
   (C)   The standard for safety from fire in buildings and structures shall be that set forth in the NFPA 101, Life Safety Code, as adopted by Winnebago County, Illinois, including any amendments, deletions, and additions thereto, and as it may be amended by the county from time to time, and is hereby, adopted and incorporated as a part of this section by reference.
   (D)   The standard regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the occupancy of buildings and premises in the Village shall be the edition of the International Fire Code including appendix chapters B, C, D, E, F and G as published by the International Code Council, and as adopted by Winnebago County, Illinois, including any amendments, deletions, and additions thereto, and as it may be amended by the county from time to time, and said Code and appendices are hereby adopted and are incorporated as a part of this section by reference.
   (E)   In addition to the standards set forth in the above-referenced Codes, any nonresidential premises containing a balcony or mezzanine area above 1 story shall be required to have a standpipe.
   (F)   Any structure used for public meetings, any commercial building and any retail business shall have sprinkler systems installed when required by the 2003 edition of the International Fire Code, as adopted herein.
   (G)   Any violation of this section shall be punishable by a fine of up to $750 per day with each day constituting a separate offense.
   (H)   Any conflict in the codes, standards, or other requirements, arising out of a difference in the texts of the ICC International Fire Code, and the NFPA 101, Life Safety Code, shall be resolved in favor of the requirements set forth in the ICC International Fire Code, as adopted.
