(A) License required. No person shall engage in the business of dealing in secondhand motor vehicles in the Village without first obtaining a license therefor.
(B) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
USED CAR DEALERS. Any person selling, exchanging or otherwise disposing of used or secondhand motor vehicles in the Village, which have not been acquired by that person in a trade-in transaction arising from and out of the sale or disposition at retail of new motor vehicles in the Village obtained or acquired under dealers’ franchises with manufacturers, shall be deemed to be engaged in the business of dealing in secondhand motor vehicles, except when making an isolated sale of his or her own motor vehicle.
(C) Special requirements.
(1) Record keeping. Any person engaged in the business of dealing in secondhand motor vehicles shall keep a record of all motor vehicles offered for sale, exchange, or disposal to the public. This record shall show the make of the motor vehicle, the year of its manufacture, its serial number and engine number and shall be kept available for inspection by the Chief of Police or police officer.
(2) Reporting altered vehicles. Every person dealing in secondhand motor vehicles shall immediately report to the Chief of Police the presence in his or her place of business of any motor vehicle on which the serial or engine number has been defaced or altered.
(3) Inspection. The Chief of Police shall make inspections at least one time per year for the purpose of seeing that the records required in this section are being kept.
(D) Issuing/investigating officer. As contemplated in § 110.04, prior to the issuance or renewal of the license, permit or registration set forth in this section, the following officer of the Village of Roscoe shall be responsible for investigating and making a recommendation as to the issuance or denial of the application: Zoning Administrator.
