§ 110.37  AMUSEMENT DEVICE LICENSE.
   (A)   License required. No person or business shall install, operate or maintain any mechanical amusement device without having first obtained a license therefor. One license shall be required for each device licensed, and it shall be placed in a conspicuous place and so affixed that it cannot be transferred from one machine to another.
   (B)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      MECHANICAL AMUSEMENT DEVICE.
         (a)   Any machine which, upon the insertion of a coin, trade token, or slug, operates or may be operated as a game or contest of skill or amusement of any kind or description, and which contains no automatic payoff device for the return of money or trade token or slugs, or which makes no provision whatever for the return of money to the player.
         (b)   Any machine, apparatus, or contrivance which is used or which may be used as a game of skill and amusement wherein or whereby the player initiates, employs, or directs any force generated by the machine.
         (c)   Any machine vending recorded music or a period of radio or television entertainment in return for the insertion or deposit therein of a coin, or of trade tokens or slugs; provided, however, that this does not include coin-operated radios or television sets in private quarters.
   (C)   Special requirements.
      (1)   In plain view. All devices licensed under this section shall at all times be kept and placed in plain view of any person who may frequent or be in any place of business where the devices are kept or used.
      (2)   Gambling. Nothing in this section shall be construed to authorize, permit, or license any gambling device of any nature whatsoever.
      (3)   Inspection. The Chief of Police shall inspect or cause the inspection of any place or building in which any such device or devices are operated or set up for operation and shall inspect, investigate, and test the devices at least once each year.
   (D)   Issuing/investigating officer. As contemplated in section § 110.04, prior to the issuance or renewal of the license, permit or registration set forth in this section, the following officer of the Village of Roscoe shall be responsible for investigating and making a recommendation as to the issuance or denial of the application: Village Clerk.
