(A) Open burning of vegetative materials shall be allowed, without permit, beginning at 8:00 a.m. on March 1 and extending through the Sunday following May 15 at 5:00 p.m. within the corporate limits of the city. Open burning may be maintained only during daylight hours. Reasonable and appropriate control and maintenance of all open burning shall be the responsibility of the property owner. Public property may not be for such burning unless conducted by the appropriate public officials. In the event that such burning may cause, upon investigation, a public nuisance, health hazard or potential therefor, the Chief of Police, or his or her designee, may order all open burning to cease and desist.
(B) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
OPEN BURNING. Igniting a fire outside of a receptacle for the containment of such materials.

OPEN BURNING shall be subject to air quality requirements of local, state and federal authority.
VEGETATIVE MATERIALS. Naturally occurring vegetable matter such as leaves, clippings and tree limbs, and does not include garbage, refuse and animal matter.
