§ 36.10 PREVAILING WAGE.
   (A)   To the extent and as required by "AN ACT" regulating wages of laborers, mechanics and other workers employed in any public works by state, county, city or any public body or any political subdivision or by anyone under contract for public works, approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in construction of public works coming under the jurisdiction of the village is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Will County area as determined by the Department of Labor of the State as of June 1997, a copy of that determination being attached hereto and incorporated herein by reference. As required by the Act, any and all revision of the prevailing rate of wages by the Department of Labor of the State shall supersede the Department's June determination and apply to any and all public works construction undertaken by the village. The definition of any terms appearing in this section which are also used in aforesaid Act shall be the same as in said Act.
   (B)   Nothing herein contained shall be construed to apply the general prevailing rate of wages as herein ascertained to any work or employment except public works construction of the village to the extent required by the aforesaid Act.
   (C)   The Village Clerk shall publicly post or keep available for inspection by any interested party in the main office of the village, this determination or any revisions of such prevailing rate of wage. A copy of this determination or of the current revised determination of prevailing rate of wages then in effect shall be attached to all contract specifications.
   (D)   The village shall mail of a copy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates.
   (E)   The village shall promptly file a certified copy of this section with both the Secretary of State Index Division and the Department of Labor of the State of Illinois.
   (F)   The village shall cause to be published in a newspaper of general circulation within the area a copy of this section, and such publication shall constitute notice that the determination is effective and that this is the determination of this public body.
   (G)   All contracts for public works entered into by the village that are subject to the Prevailing Wage Act (ILCS Ch. 820, Act 130, §§ .01 et seq.) and the provisions of this section shall be required to include the text hereinafter set forth in the written contract, bid, bid notice, project specification, purchase order or other written documentation memorializing the contract for such public works:
      "This contract calls for the construction of a "public work," within the meaning of the Illinois Prevailing Wage Act, 820 ILCS 130/.01 et seq. ("the Act"). The Act requires contractors and subcontractors to pay laborers, workers and mechanics performing services on public works projects no less than the "prevailing rate of wages" (hourly cash wages plus fringe benefits) in the county where the work is performed. For information regarding current prevailing wage rates, please refer to the Illinois Department of Labor's website at: http://www.state.il.us/agency/idol/rates/rates.HTM. All contractors and subcontractors rendering services under this contract must comply with all requirements of the Act, including but not limited to, all wage, notice and record keeping duties."
The proper officers of the village may from time to time require all contractors on public works contracts to execute appropriate acknowledgments evidencing such contractors' receipt of the above-mentioned notice.
