A Plan Commission, consisting of seven members, is hereby created, four of whom shall be citizen members, two of said citizen members appointed for a term of three years, and two appointed for a term of four years, and no more than any two of the said citizen members shall be members of the same political party, and the said Plan Commission shall be empowered to do all things necessary and proper in accomplishing its objective as set out in I.C. 36-7-4 and as the same has been or may hereinafter be amended.

As to § 150.01, the original ordinance first stipulated three, rather than four, citizen members of the Plan Commission. As this is contrary to statute, and as the original ordinance itself then goes on to describe a total of four such members, the word “three” was interpreted as a typographical error and was editorially changed to “four” upon codification. By statute, the citizen members are appointed by the Town Council President; the remaining three members are appointed by the Town Council as a whole from among officers or other personnel of the town government (I.C. 36-7-4-207(b)). After the initial terms of citizen members, which expires on the first Monday of January on the third and fourth years, respectively, after appointment, all successive terms are for four years (I.C. 36-7-4-218(b)). Town government members have no definite term under statute, and in general would, once appointed, continue to serve so long as they remained members of the town government, unless removed for legal cause; however, in the case of any such member who was a Town Council member, the Town Council would have the option of appointing a new member at its first regular meeting of any year pursuant to I.C. 36-7-4-217. Members of a Plan Commission, once appointed and qualified, may be involuntarily removed only for proper legal cause.
