§ 96.001 CUTTING/TRIMMING OF TREES.
   (A)   The Town Council hereby asserts, assumes and takes control of all shade trees, shrubbery or other ornaments within the streets of the town.
   (B)   It shall be unlawful for any person to cut, trim, mutilate or in any way disturb any such tree or shrub, or the boxing or covering thereof, without obtaining a permit from the Town Council, which permit shall prescribe the terms and conditions thereof. A fee of $5 shall be charged for the permit.
   (C)   In addition, before cutting/trimming any tree along the streets of the town, the property owner shall give at least one day’s notice to the Superintendent of the town’s electric utility, stating the time and place where such cutting or trimming will be done, so that he or she may be present to protect the electric wires belonging to the town; however, a permit or notice to the Electric Utility Superintendent is not required when, in an emergency, the condition of a tree is such as to pose an imminent danger to life or property which can only be relieved by the immediate cutting or trimming of the tree; but any person cutting or trimming a tree under this authority shall, within three days thereafter, file a written statement with the Town Council, describing the necessity for the emergency action.
