(A) Except as hereafter provided in this chapter with respect to any town street or other publicly maintained vehicular thoroughfare, or as otherwise fixed and posted by the State Department of Highways with respect to any state-maintained route passing through the town, the presumptive or prima facie speed limits as set forth in I.C. 9-21-5-1 through 9-21-5-5 shall apply and be enforced on all public ways within the town, as follows, whether or not signs are posted:
(1) In any urban district of the town (as defined by I.C. 9-13-2-193, as amended), the speed limit is 30 mph; and
(2) In any other area, the speed limit is 55 mph.
(B) Any person violating a speed limit as described in this section shall be cited and prosecuted for a violation of state law, and liable for penalties as provided by law or in accordance with a schedule of judgments fixed by the court of jurisdiction.
