§ 151.03 DEFINITIONS.
   For the purpose of this chapter, certain terms and words are hereby defined. Words used in the present tense shall include the future; the singular number shall include the plural and the plural the singular. The word SHALL is mandatory and MAY is permissive.
   ACCESSORY USE or BUILDING. A use or building on the same lot with and of a nature of customarily incidental and subordinate to the principal use of a building.
   ACT. The Mobile Home and Mobile Home Park Act (Ill. Rev. Stat. 1983, Chapter 111.5 Pars. 711 et seq.).
   AFFIDAVIT. An oath in writing, sworn before and attested to an individual who has the authority to administer an oath.
   APPLICANT. Any person making application for a license to operate or permit to construct or alter a mobile home park.
   BUILDING. Any structure designed or built for the support, enclosure, shelter, or protection of people, animals, chattels, or property of any kind.
   BUILDING PERMIT. A permit issued by the Zoning and Building Department for the construction of an accessory building or structure, repairs to an existing mobile home, placement of a mobile home on a space in a licensed mobile home park, including, but not limited to, sewer, water and heating fuel connections, electrical service and connecting wiring and/or supply cords.
   CONSTRUCTION IN A FLOODPLAIN. The placement or erection of structures or earthworks; land filling, excavation, or other non-agricultural alternation of the ground surface; installation of public utilities channel modification; or storage of materials or any other activity undertaken to modify the existing physical features of a floodplain with respect to the storage and conveyance of floodwaters.
   COUNTY. The County of Rock Island, Illinois.
   DEPARTMENT. Either the State Department of Public Health, County Public Health Department, or the County Zoning and Building Department, as specified.
   DIRECTOR. Either the Director of the Department of Public Health, the County Public Health Department Director, or the Code Enforcement Administrator of the county.
   DIVISION OF WATER RESOURCES. The State Department of Transportation, Division of Water Resources, Department of Transportation Administration Building, Room 300, Springfield, Illinois 62764.
   FLOOD MAPS. The Flood Hazard Boundary Maps, Community Panel Numbers 170582 0001-0200, effective August 2, 1982, including revisions.
   FLOODWAY. The portion of the special flood hazard area required to store and convey the base flood.
   IMMOBILIZED MOBILE HOME. Any structure served by individual utilities and resting on a permanent foundation with wheels, tongue and hitch permanently removed, and properly secured in compliance with the State Manufactured Housing and Mobile Home Safety Act (Ill. Rev. Stat. 1983, Ch 67.5, Pars. 501 et seq.) and/or the State Mobile Home Tie Down Act (Ill. Rev. Stat. 1983, Ch 111.5, Pars. 4401 et seq.) and the Department’s regulations for the Mobile Home Tie Down Act (77 Ill. Adm. Code 870) in accordance with the following criteria:
      (1)   The foundation shall extend into the ground below the frost line (minimum depth is 42 inches) so as to attach and become part of the real estate. Materials such as concrete, mortared concrete block, or mortared brick shall be used; and
      (2)   Where the mobile home is secured to the foundation in accordance with the current County Building Code, it shall be deemed to satisfy the requirements for a permanent foundation.
   LICENSE. A certificate issued by the Zoning and Building Department allowing a person to operate and maintain a mobile home park under the provisions of the Act and this chapter.
   LICENSEE. Any person having a license or permit to construct a mobile home park under the Act and this chapter.
   MOBILE HOME. A structure, transportable in one or more sections, which is eight body feet or more in width and is 32 body feet or more in length, and which is built on a permanent chassis, and designed to be used as a dwelling with or without permanent foundation, when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein. A travel trailer is not to be considered a MOBILE HOME.
   MOBILE HOME PARK. A lot upon which two or more occupied mobile home dwellings are harbored either free of charge or for revenue purposes.
   OWNER or OPERATOR. The licensee.
   PERMIT. A certificate issued by the Zoning and Building Department permitting the construction, alternation, reduction in number of spaces, or the change in ownership of a mobile home park under the provisions of the Act and this chapter.
   PERSON. Any individual, group of individuals, association, trust, partnership, corporation, persons doing business under an assumed name, county, municipality, the state, or any political subdivision or department thereof, or any other entity.
   PUBLIC BATHING BEACH.
      (1)   Any body of water, or that portion thereof used for the purpose of public swimming or recreational bathing, and includes beaches at apartments, condominiums, and other groups or associations having five or more living units, clubs, churches, camps, schools, institutions, parks, recreational areas, motels, hotels, and other commercial establishments.
      (2)   It includes shores, equipments, buildings, and appurtenances pertaining to such areas. It does not include bathing beaches at private residences intended only for the use of the owner and guests.
   REVOCATION. To declare invalid a permit or license issued to the applicant or licensee by the Zoning and Building Department for an indefinite period of time.
   SPACE. A site for a mobile home.
   SPECIAL FLOOD HAZARD AREA. An area having special flood hazards and shown as such on a regulatory floodplain map (published and available from the Division of Water Resources or Flood Insurance Rate Map or Flood Hazard Boundary Map published by the Federal Insurance Administration of the Federal Emergency Management Agency).
   STATE FLOODPLAIN REGULATIONS. The rules set forth for the regulation of construction within the floodplains (92 Ill. Adm. Code 706) issued by the Division of Water Resources.
   STRUCTURE. Anything constructed or erected with a fixed location on the ground, or attached to something having a fixed location on the ground. Among other things, structures include buildings, mobile homes, walls, fences, bulk storage tanks, billboards, and poster panels.
   SUSPENSION. To declare invalid a permit or license issued to the applicant or license by the Zoning and Building Department for a temporary period of time with an expectation of resumption.
   SWIMMING POOLS/PONDS, PRIVATE. A tank or pond of water wither above or below grade level in which the depth of water exceeds 18 inches. Swimming pools, hot tubs, whirlpool baths and tubs, and jacuzzi-type tubs or baths shall be considered SWIMMING POOLS if they are located outside.
   SWIMMING POOL, PUBLIC. Any artificial basin of water which is modified, improved, constructed, or installed for the purpose of public swimming, and includes pools for community use, pools at apartments, condominiums, and other groups or associations having five or more living units, clubs, churches, camps, schools, institutions, YMCAs, YWCAs, parks, recreational areas, motels, hotels, and other commercial establishments. It does not include pools at private residences intended only for the use of the owner and guests.
   TRAVEL TRAILER. A vehicular portable structure built on a chassis, designed to be used as a temporary dwelling for travel and recreational purposes, having a body width not exceeding eight feet.
   UNSAFE BUILDING or STRUCTURE. Buildings or structures which have structural defects or are not provided with adequate egress, light, and ventilation, or have extensive fire damage or are otherwise constituting a hazard to safety, health, or public welfare.
