§ 130.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Any person violating § 130.01 shall be subject to a citation. The citation may be paid at the office of the Circuit Clerk. A fine of $25 shall be assessed if the citation is paid within 48 hours after issuance, excluding weekends and court holidays. A fine of at least $50 shall be assessed thereafter. In lieu of a fine for a first offense, a person who pleads or is found guilty of violating § 130.01 may elect to attend a tobacco use class presented by the American Lung Association or any other organization approved by the court at his or her own expense. Upon proof of successful completion of the class within a reasonable amount of time to be determined by the court, the fine shall be waived.

   (C)   Any person violating § 130.02 shall be subject to a citation. The citation shall be paid at the office of the Circuit Clerk. A fine of $50 shall be assessed for the first such violation of § 130.02. A fine of at least $75 shall be assessed thereafter. In lieu of a fine in the first offense, a person who pleads or is found guilty of violating § 130.02 may elect to attend an alcohol prevention class presented by an acceptable organization approved by the court at his or her own expense.
