§ 34.51 DEFINITIONS.
   For purposes of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   MARIJUANA. All parts of the plant of the Cannabis family Moraceae, including seeds, whether growing or not; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its resin, as may be defined by Oregon Revised Statutes as they currently exist or may from time to time be amended. MARIJUANA does not include the:
      (1)   Mature stalks of the plant which are defined as stalks without leaves, immature buds, seeds or roots attached;
      (2)   Fiber produced from the stalks;
      (3)   Oil or cake made from the seeds of the plant;
      (4)   Any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks (except the resin extracted there from);
      (5)   Fiber, oil, or cake of the marijuana plant which do not contain cannabinoids; or
      (6)   Sterilized seed of the plant which is incapable of germination.
   MARIJUANA ITEM. The meaning given that term in O.R.S. Chapter 614, § 1, and includes MARIJUANA as defined above.
   MARIJUANA RETAILER. A person who sells marijuana or marijuana items to a consumer where one or both persons are within the jurisdiction of the city. The transactions here include recreational and medical marijuana retail sales, unless otherwise specifically exempted by Oregon law enacted in advance of the effective date of this subchapter.
   RETAIL SALE PRICE. The price in money, goods, services and/or other valuable consideration, excluding any tax, exchanged between a marijuana retailer and another person as, or on behalf of, a consumer of a marijuana item.
   SALE. The object, action or result of a sale, transfer, mixing, handling and/or serving of an item by or from one person to another for money or other valuable consideration. SALE includes selling, sells and any other similar word of an exchange.
