§ 131.040 DISCHARGE OF WEAPON; WEAPON DISCHARGE PERMIT.
   (A)   No person shall fire or discharge a weapon within the corporate limits of the city or within land owned or controlled by the city.
   (B)   Weapon means any instrument capable of causing serious physical injury, damage or death to a person or to property by means of, or when used as, a projectile of any kind. Weapon includes but is not limited to firearms, bow and arrows, crossbows, spear, sling-shot, pellet and BB guns, knife, ax, and/or any other substance such as a chemical acid or base. Weapon includes fireworks meeting the above definition, including Chinese or other uncontrolled, lighter-than-air lanterns propelled by a candle or other source of combustion, but excludes fireworks discharged in compliance with Oregon State Fire Marshal regulations or any applicable local, state or federal permit or law.
   (C)   Division (A) shall not apply to:
      (1)   A police officer in the performance of his or her duties;
      (2)   Any other person acting in self-defense or the defense of another human;
      (3)   A person who first obtains from the city a weapon discharge permit for a limited purpose and upon such terms as are reasonably necessary to protect the general health, safety and welfare interests of the city and its citizens;
      (4)   A person participating in any sport connnonly associated with, and sponsored by, K through 12th grade school athletics;
      (5)   Any person or act authorized by, or protected by, the laws and constitutions ofthe State of Oregon and/or the United States of America.
   (D)   Limited purposes for a weapon discharge pennit include, but are not limited to, the lawful harvest or taking of a wild or destructive animal, or the lawful use of a weapon at a firing range or at any event requiring a pennit or prior city approval. The City Manager or City Manager's designee and the permit applicant shall agree on reasonably necessary safety terms as permit conditions. Otherwise, the permit application shall be referred to the City Council for a decision. The Council may by resolution establish and amend:
      (1)   A fee or fee schedule; and
      (2)   Standard necessary safety terms for a weapon discharge permit.
