(A) Curfew hours. No person under the age of 18 years shall be, or remain in, or upon any street, highway, park, alley or other public place between the hours specified in this section, except as set forth in § 130.02.
(1) For children 14 years of age and under, the hours shall be between 9:00 p.m. Sunday, Monday, Tuesday, Wednesday and Thursday, and 6:00 a.m. of the following morning; and between 10:00 p.m. on Friday and Saturday, or any day prior to a legal holiday when no school is scheduled for that day, and 6:00 a.m. of the following morning; except that during the months of June, July and August, the hours shall be between 10:00 p.m. and 6:00 a.m. of the following morning.
(2) For children 15 years of age and over, the hours shall be between 10:00 p.m. Sunday, Monday, Tuesday, Wednesday and Thursday, and 6:00 a.m. of the following morning; and between 12:00 midnight on Friday and Saturday, or any day prior to a legal holiday when no school is scheduled for that day, and 6:00 a.m. of the following morning; except that during the months of June, July and August, the hours shall be between 12:00 midnight and 6:00 a.m. of the following morning.
(B) Parental responsibility. No parent, guardian or any person having the care or custody of any child under the age of 18 years shall permit or by inefficient control, allow the child to be in or remain in or upon any street, alley, park or other public place between the hours set forth in division (A) above and contrary to the provisions of this chapter. Proof that the child was on any street, alley, park or other public place at a time prohibited shall be prima facie and sufficient evidence to sustain a conviction of a violation of this section.
(C) Enforcement. If any child is found upon any street, alley, park or other public place within the city in violation of this chapter, it shall be the duty of any police officer to take the child into temporary custody; and for the first violation, he or she shall as soon as practicable thereafter notify the child's parent, guardian or other person responsible for the child of the violation and shall take or send the child home and release the child to the custody of his or her parent or other person responsible. In any case in which the child under the age of 18 years shall again violate any provisions of this chapter, the child may be apprehended and taken into temporary custody as a juvenile offender and delinquent and be subject to the penalties provided in this chapter.
