§ 93.09 CITY MAY MAKE REPAIRS UPON PROPERTY OWNER’S FAILURE.
   (A)   In the event any property owner having property abutting upon any sidewalk, which is in a dangerous or unsafe condition shall fail to repair the sidewalk within 10 days after the service of notice upon him or her, the City of Rockaway Beach may proceed to repair or rebuild the sidewalk. After the sidewalk is repaired or rebuilt, the City Recorder shall report to the City Council all expenses incurred by the city, in repairing or rebuilding of the sidewalk.
   (B)   The total amount of the expenses incurred by the city in repairing or rebuilding the sidewalk shall be declared by a resolution to be a lien upon the property abutting upon the repaired or rebuilt sidewalk. The lien declared upon any property pursuant to the city. The city may proceed to foreclosure or enforce any lien to which it shall be entitled pursuant to the provisions of this subchapter at any time after 30 days after the date on which the assessment was entered in the city lien docket of the city.
   (C)   The manner of foreclosure or enforcement of any lien by the city shall be pursuant to the general laws of the state of Oregon. In the event suit or action is brought to foreclosure or enforce any lien, the city shall be entitled to recover from the defendant, in addition to the lien, a reasonable attorney fee to be determined by the court.
