§ 93.01 DECLARATION TO CONSTRUCT SIDEWALK.
   Whenever the City Council of the City of Rockaway Beach, Oregon, shall deem it expedient that any new sidewalk shall be constructed within the city, the Council shall pass a resolution declaring that the construction of the sidewalk is expedient and describe in the resolution with convenient certainty the location thereof, the kind of material required to be used in the construction thereof and the time within which the same shall be completed; provided, that the owners of the property adjacent to and abutting upon the proposed sidewalks shall be allowed at least 10 days from the passage of the resolution within which to complete the construction of any sidewalk. The resolution shall provide that the proposed sidewalks are to be constructed at the expense of the owners of the property adjacent to and abutting upon the proposed sidewalk. The resolution shall also provide that all actual costs in the preliminary planning of proposed sidewalks, as well as all other costs of construction, shall be assessed against the property adjacent to and abutting upon the sidewalks constructed under this subchapter.
