(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) (1) The penalty for violating § 132.05 shall be as follows:
(a) Possession of cannabis. For possession of ten grams or less for any substance containing cannabis:
1. First offense: $150; and
2. Second offense: $250.
(b) Possession of drug paraphernalia. For possession of drug paraphernalia:
1. First offense: $150; and
2. Second offense: $250.
(2) The Police Department may in its discretion refer charges of possession of cannabis to the State’s Attorney for charges pursuant to state law instead of bringing charges pursuant to this chapter, but no person shall be charged pursuant to this chapter and state law for the same offense. Possession of cannabis in excess of ten grams is not subject to this chapter, but rather, shall be referred to the State’s Attorney to be charged pursuant to state law.
