(A) Purpose. The purpose of this noise section is to protect, preserve and promote the health, safety, welfare, peace and quiet of the residents of the village through the reduction, control and prevention of noise that unreasonably disturbs, injures or endangers the comfort, repose, health, peace or safety of reasonable persons of ordinary sensitivity. This section seeks to establish common sense guidelines that residents and businesses can follow, that promotes a more restful, pleasant environment.
(B) Policy. It shall be the policy of the village to discourage, reduce and, where reasonably feasible, require the mitigation of any noise, regardless of how generated, produced or broadcasted, which is perceived by an individual of ordinary and reasonable sensibilities to be of such a level, duration, nature or character as annoying, disturbing, injurious, harmful, dangerous or otherwise unsafe.
(C) Authority. The corporate authorities of each municipality may prevent or suppress riots, routs, affrays, noises, disturbances, trespasses and disorderly assemblies in any public or private place.
(D) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
NOISE DISTURBANCE. Sound that:
(a) Is loud and raucous which annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others, within the limits of the village regardless of time of day or night; or
(b) Exceeds the sound level limit set forth in this section, as measured by a sound level meter or is a sustained sound left unattended.
(E) Exceptions.
(1) Cries or loud calls for emergency assistance or of warning;
(2) Radios, sirens, horns or bells which emanate from police, fire, ambulance or other emergency response vehicles;
(3)
Special events such as parades, races, fireworks displays, outdoor music, and block parties, for which the village has issued a special events permit pursuant to village approval, permit or license and all village codes;
(4) Activities on or in municipal and school athletic facilities and on or in publicly owned property and facilities provided that such activities have been authorized by the owner or operator of such municipal or school property;
(5) Fire alarms and security alarms prior to the giving of notice and a reasonable opportunity for the owner or tenant of the premises, Police Department, Fire Department or other first responders to turn off or otherwise cancel the alarm or security system;
(6) Religious worship activities including, but not limited to, the ringing of bells, the playing of musical instruments, the singing or chanting of choirs, or the singing or chanting of those in attendance at such worship activities;
(7) Clock towers, bell towers and carillons;
(8) Sounds generated between the hours of 8:00 a.m. and 10:00 p.m. in construction, demolition or repair work pursuant to duly authorized permit or franchise or license agreement;
(9) Sounds generated in construction, demolition or repair work of an emergency nature or in work on public improvements authorized by a governmental body or agency;
(10) Rail locomotives and other railroad equipment;
(11) Aircraft;
(12) Generators and pumps used to relieve an emergency situation such as electrical power outages or flooding of buildings and the like, and their required scheduled maintenance operation;
(13) Power equipment for property maintenance from dawn to dusk, including, but not limited to, mowers, weed trimmers, leaf blowers, air compressors, chainsaws, saws, drills, and other similar power tools; and
(14) Mechanical stationary noise of less than 80 decibels at its source.
(F) Enforcement.
(1) If a police officer determines that there is a noise disturbance, he or she may enforce this section by issuing an ordinance violation citation to the violators.
(2) Residents are encouraged to report a noise disturbance in their areas by providing the following information:
(a) Name, address and phone numbers. A caller may wish to remain anonymous, but this information is helpful in successful enforcement of this section and is required to enforce a noise violation based solely on disturbing a reasonable person of normal sensitivities;
(b) Location of the source of the noise disturbance and address is possible; and
(c) Description of the type of noise, such as loud music, a loud party and the like (being as descriptive as possible), and the length of the disturbance.
