§ 97.07 PUBLIC TREE CARE.
   (A)   The city shall have the right to plant, prune, maintain and remove trees, plants and shrubs within the lines of all streets and public grounds, as may be necessary to ensure public safety or to preserve or enhance the symmetry and beauty of such public grounds.
   (B)   The City Tree Board may remove or cause to be removed any tree or part thereof which is in an unsafe condition or which, by reason of its nature, is injurious to sewers, electric power lines, gas lines, water lines or other public improvements, or is affected with any injurious fungus, insects or other pests.
   (C)   The city or public utilities may trim or remove any trees which endanger the public, inhibit the passage on city streets, or interfere with utilities and public infrastructure if the Mayor or Operations Manager reasonably believes that public safety requires action prior to the next regularly scheduled city Tree Board meeting. Topping and the severe cutting back of limbs may be allowed under emergency conditions. the city may act without prior notification to the property owner in such circumstances.
