§ 51.49 CHARGES BASED ON VOLUME, STRENGTH AND CHARACTER OF WASTE DISCHARGED.
   (A)   In order that the rates and charges may be justly and equitably adjusted to the service rendered to users, the city shall base its charges not only on the volume, but also on strength and character of the stronger-than-normal domestic sewage and wastes which it is required to treat and dispose of. The city shall require the user to determine the strength and content of all sewage and wastes discharged, either directly or indirectly into the sanitary sewage system, in such manner, by such method, and at such times as the city may deem practicable in light of the conditions and attending circumstances of the case, in order to determine the proper charge. The user shall furnish a central sampling point available to the city at all times.
   (B)   Normal sewage domestic waste strength should not exceed a carbonaceous biochemical oxygen demand of 250 milligrams per liter of fluid, ammonia in excess of 20 milligrams per liter of fluid, suspended solids in excess of 250 milligrams per liter of fluid, or chemical oxygen demand in excess of 500 milligrams per liter of fluid. Additional charges for treating stronger-than-normal domestic waste shall be made on the following basis:
      (1)   ALL CLASS I AND CLASS II USERS.
         (a)   Phase I - Effective January 1, 2024.
            1.   Rate surcharge based upon suspended solids. There shall be an additional charge of $0.11 per pound of suspended solids for suspended solids received in excess of 250 milligrams per liter of fluid.
            2.   Rate surcharge based upon CBOD. There shall be an additional charge of $0.11 per pound of carbonaceous biochemical oxygen for CBOD received in excess of 250 milligrams per liter of fluid.
            3.   Rate surcharge based upon ammonia. There shall be an additional charge of $0.43 per pound of ammonia for ammonia received in excess of 20 milligrams per liter of fluid.
            4.   Rate surcharge based upon COD. There shall be an additional charge of $0.05 per pound of COD for COD received in excess of 500 milligrams per liter of fluid.
         (b)   Phase II - Effective July 1, 2024.
            1.   Rate surcharge based upon suspended solids. There shall be an additional charge of $0.13 per pound of suspended solids for suspended solids received in excess of 250 milligrams per liter of fluid.
            2.   Rate surcharge based upon CBOD. There shall be an additional charge of $0.13 per pound of carbonaceous biochemical oxygen for CBOD received in excess of 250 milligrams per liter of fluid.
            3.   Rate surcharge based upon ammonia. There shall be an additional charge of $0.49 per pound of ammonia for ammonia received in excess of 20 milligrams per liter of fluid.
            4.   Rate surcharge based upon COD. There shall be an additional charge of $0.06 per pound of COD for COD received in excess of 500 milligrams per liter of fluid.
         (c)   Phase III - Effective January 1, 2025.
            1.   Rate surcharge based upon suspended solids. There shall be an additional charge of $0.15 per pound of suspended solids for suspended solids received in excess of 250 milligrams per liter of fluid.
            2.   Rate surcharge based upon CBOD. There shall be an additional charge of $0.15 per pound of carbonaceous biochemical oxygen for CBOD received in excess of 250 milligrams per liter of fluid.
            3.   Rate surcharge based upon ammonia. There shall be an additional charge of $0.56 per pound of ammonia for ammonia received in excess of 20 milligrams per liter of fluid.
            4.   Rate surcharge based upon COD. There shall be an additional charge of $0.07 per pound of COD for COD received in excess of 500 milligrams per liter of fluid.
   (C)   System development charge. New users that connect to the sewer collection system for purposes of sending sewage to the wastewater treatment plant shall pay a system development charge in an amount equal to:

   (D)   Bulk waste (septic) charge. Commercial/domestic waste delivered to the city’s plant by customer’s truck or tank shall be billed at a rate of $0.07 per gallon for Phase I, $0.08 per gallon for Phase II, and $0.09 per gallon for Phase III. This section excludes waste delivered by Republic Landfill (a.k.a. County Line Landfill Partnership) which is contracted for under separate agreement.
