§ 95.08 VIOLATIONS AND ENFORCEMENT.
   (A)   Any person found in violation of this chapter shall be subject to the following procedures.
      (1)   Any person authorized in § 95.01 of this chapter shall issue a warning to a first-time violator stating that he or she is in violation. The person must then correct the violation by immediately extinguishing the fire. In the event that the violator is not the owner, a copy of the warning shall be mailed to the owner.
      (2)   Failure or refusal to immediately extinguish the fire shall result in a citation being issued and the Fire Department may enter upon the property to extinguish the fire.
   (B)   Each subsequent starting, kindling, causing or allowing of a new fire after a warning or citation has been issued, shall be considered a separate, chargeable offense.
   (C)   A citation issued by any person authorized in § 95.01 of this chapter shall result in the imposition of the penalty prescribed in § 95.99 of this chapter. In the event that the violator is not the owner, a copy of the citation shall be mailed to the owner.
   (D)   Appeals of a citation may be made in a writing filed with the Clerk-Treasurer not more than ten calendar days following the issuance of the citation and shall be heard and decided by the Town Council at a public meeting.
