6-1-34: DUMPING ON VILLAGE PROPERTY:
   (A)   Dumping Prohibited: It shall be unlawful to dump or place any garbage, refuse, ashes, or any unwanted item or unwanted material on any village property or in any village receptacle at any time unless such person or entity has express prior consent from the village to dump or place garbage, refuse, ashes, or any unwanted item or unwanted materials on village property or in a village receptacle.
   (B)   Signage: The Village shall post signage on or near village property or village receptacles in a location that provides reasonable notice and warning to violators and potential violators that dumping is prohibited on the property or in the receptacle and that a minimum fine of five hundred dollars ($500.00) will be imposed for any violations of this “no dumping" provision. However, the violator's lack of knowledge or viewing of such signage shall not be a defense to committing a violation of this Section.
   (C)   Penalty: A person or entity violating this section shall be fined not less than five hundred dollars ($500.00) for each such offense. A person violating this section within twelve (12) months of the first violation shall be fined not less than seven hundred fifty dollars ($750.00) for each such offense. The chairperson of the village's ordinance committee shall be permitted to issue administrative citations for violations of this section under section 1-4-13 of this code. A separate offense shall be deemed committed on each date upon which a violation occurs. In addition to any fine imposed for a violation of this section of the Village Code, a person convicted of a violation of this section shall be required to reimburse the Village for the reasonable cost of removal and disposal of the garbage, refuse, ashes, unwanted item, or unwanted material dumped or placed on village property or in a village receptacle in violation of this section.
