1-4-13: ADMINISTRATIVE PROCESS FOR ORDINANCE VIOLATIONS:
   (A)   Any village officer authorized to enforce the provisions of this code, including any law enforcement officer acting on behalf of the village and the code official as set forth in section 7-4-13 of this code, may issue and serve administrative enforcement citations to an offender for a violation of this code. Furthermore, the village clerk may issue administrative enforcement citations by certified mail to the offender.
   (B)   Every administrative enforcement citation issued under this provision shall impose a fine of one hundred dollars ($100.00) to be paid to the village of Roanoke, unless the code provision specifically provides a lesser fine, in which case the maximum fine specifically set forth in such code provision shall be paid to the village of Roanoke. A fine of two hundred dollars ($200.00) shall be imposed for a second violation of the same code provision by the same person or responsible party within a twelve (12) month period beginning on the date of the first violation of the particular code provision. A fine of three hundred dollars ($300.00) shall be imposed for a third or subsequent violation of the same code provision by the same person or responsible party within a twelve (12) month period beginning on the date of the first violation of the particular code provision. If a provision of this code provides for a penalty of less than one hundred dollars ($100.00) for a first offense charged as an administrative enforcement action under this section, then the specific fine amount set forth for a first offense shall be doubled for a second offense and tripled for a third or subsequent offense during the twelve (12) month period as described above in this section. Payment of any fine under this section shall be made to the village clerk at the village hall. Any check tendered to pay a fine under this section which is returned to village unpaid for any reason shall not be considered to be "full payment" under this section.
   (C)   The offender shall pay any fine imposed under this section within thirty (30) calendar days, unless a shorter period of time is specifically provided by the applicable code provision. If the fine imposed under this provision is not paid within the required thirty (30) day period, the fine shall increase as provided herein. If the fine is imposed for a first violation within a twelve (12) month period and is not paid within the required thirty (30) day period, the fine shall be increased to two hundred fifty dollars ($250.00) to be paid to the village, regardless of the amount of the fine for this initial offense in a twelve (12) month period if the fine was paid during the required thirty (30) day period. If the fine is imposed for a second violation within a twelve (12) month period and is not paid within the required thirty (30) day period, the fine shall be increased to three hundred fifty dollars ($350.00) to be paid to the village, regardless of the amount of the fine for this second offense in a twelve (12) month period. If the fine is imposed for a third or subsequent violation within a twelve (12) month period and is not paid within the required thirty (30) day period, the fine shall be increased to four hundred fifty dollars ($450.00) to be paid to the village, regardless of the amount of the fine for this third or subsequent offense in a twelve (12) month period.
   (D)   This administrative enforcement process shall not initiate any court proceedings related to a particular violation of this code and shall be independent of any court proceeding related to the enforcement of this code. Furthermore, action taken under this section shall not prevent the village from pursuing other types of enforcement action against the offender or another person for the same violation. However, any violation of this code which is concluded by the full payment of the fine amount set forth above by the offender in the specified time period shall not be brought by the village as an action against that offender to recover a fine for such violation in a court proceeding.
