§ 130.03  NOISE.
   (A)   It shall be unlawful for any person within the town:
      (1)   To use or operate any musical instrument, music player, radio, stereo, television set or other machine or device for the production or reproducing of sound at such a volume as to disturb the peace, quiet and comfort of neighboring residents or any reasonable person of normal sensitiveness residing or working in the area;
      (2)   To create any noise on any street, sidewalk or public place adjacent to any church or school while the same is in use, which noise unreasonably interferes with the working of such institution, provided conspicuous signs are displayed in such streets, sidewalk or public place indicating the presence of a church or school;
      (3)   To create any noise on any street, sidewalk, private or public place, which noise unreasonably interferes, disturbs the peace, quiet and comfort of neighboring residents or any reasonable person of normal sensitiveness working or residing in the area;
      (4)   To keep or maintain, or permit the keeping of, upon any premises owned, occupied or controlled by such person any animal or fowl otherwise permitted to be kept which, by any sound, cry or behavior, shall cause annoyance or discomfort to a reasonable person or normal sensitiveness; or
      (5)   To operate any machinery, construction equipment, home repair equipment, equipment to repair, rebuild or test motor vehicles, pump, fan, compressor, wrench, drill, hammer, air conditioning apparatus or similar mechanical device, mobile or fixed, or to run, operate or test any type of motorized vehicle, in any manner so as to create any noise as to disturb the peace, quiet and comfort of neighboring residents and/or persons between the hours of:
         (a)   10:00 p.m. on a Sunday, Monday, Tuesday, Wednesday or Thursday and 6:00 a.m. of the following day;
         (b)   11:00 p.m. on a Friday or Saturday and 7:00 a.m. of the following day;
         (c)   On such dates and times as may be established by the Town Council from time to time, with due notice of any such special event having been made in advance to those persons affected; and
         (d)   Noises created by power grass and weed cutting, garden equipment, or tree trimming equipment are limited to the hours of 8:00 a.m. and 9:00 p.m. seven days a week, as long as they are used as intended by the manufacturer and in such a manner that a reasonable person of normal sensitiveness residing or working in the area is not caused discomfort or annoyance.
   (B)   The following uses and activities shall be exempt from noise level regulations:
      (1)   Noises of safety signals, warning devices and emergency pressure relief valves;
      (2)   Noises resulting from any authorized emergency vehicle, when responding to an emergency call or acting in the time of an emergency; and
      (3)   Noise resulting from emergency work.
