§ 111.03  EXCEPTIONS.
   This chapter shall not apply to:
   (A)   Minor children who are residents of the town;
   (B)   Students and other persons affiliated with the North Putnam Community School Corporation;
   (C)   Home-school students and their family members who reside within the boundaries of the North Putnam Community School District;
   (D)   Not-for-profit entities which are exempt from the state’s gross retail tax under I.C. 6-2.5-5-23, as same may be amended from time to time;
   (E)   Any entity that is exempt from local licensing pursuant to state law, regulation or ordinance;
   (F)   Any entity that is registered with the town to do business in the town;
   (G)   Any person delivering newspapers, fuel, dairy products, bakery goods or groceries to regular customers on established routes; or
   (H)   Any person who has an established place of business where the goods being sold are offered for sale on a regular basis and in which the buyer has initiated contact with, and specifically requested a home visit by said person.

§ 111.04  VIOLATORS.
   (A)   Any unexempted business, organization, club or individual that engages in the business of peddler or solicitor within the town violates this chapter and commits a nuisance.
   (B)   Further, it shall be unlawful for a person soliciting door-to-door in the town to:
      (1)   Call at the rear or side door of any place or dwelling unless it is clearly marked to do so in the front of the dwelling;
      (2)   Remain on the premises after being asked to leave by the owner, occupant or other person having authority over such premises;
      (3)   To misrepresent or make false, deceptive or misleading statements while engaged in canvassing, the purpose of his or her business, identity or the identity of the organization he or she represents;
      (4)   To impede the free use of sidewalks, streets and/or alleys by pedestrians and vehicles. Where the sales are made from vehicles, all traffic and parking regulations shall be observed;
      (5)   To make any loud noises or use any sound amplifying device to attract customers if the noise produced is capable of being plainly heard outside a 100-foot radius or more; and
      (6)   To allow rubbish or litter to accumulate in or around the area in which he or she is conducting business.

§ 111.05  HOURS OF SOLICITATION.
   (A)   Soliciting may be only be done between the hours of 9:00 a.m. and 7:00 p.m.
   (B)   Soliciting may not be conducted at any dwelling or other place between the hours of 7:00 p.m. and 9:00 a.m., except by previous scheduled appointment.
   (C)   Soliciting may not take place at any dwelling or other place where a sign is a displayed bearing the wording “No Solicitors”, “No Soliciting”, “No Peddlers” or words of similar meaning.

§ 111.99  PENALTY.
   Any business, organization, club or individual violating the provisions of this chapter shall, upon violation, be fined the sum of $100. Each separate act of solicitation shall constitute a separate violation.
