(A) No person operating a motor vehicle within the corporate limits of the town shall use an exhaust brake or engine compression brake.
(B) Prohibitions contained in this section shall not be applicable to:
(1) Emergency or public safety vehicles;
(2) Vehicles owned and operated by a unit of government or a utility company; or
(3) Any motor vehicle used in an activity for which a permit or exception has been granted by the Town Council.
(C) Town officials are hereby authorized to acquire and post appropriate signage at the town limits advising of this restriction.
(D) Any person or entity who is in violation of this section shall be deemed to have committed a civil ordinance violation and may be issued a citation by a law enforcement officer.
