8-2-25: STREET OR SIDEWALK SALES ACTIVITIES:
Use of any public street, sidewalk, parkway or other public area for the sale of merchandise by any merchant or by any local civic, charitable or religious organization shall be permitted only upon issuance of a special permit by the village manager, following application for such permit, on forms supplied by the village, and reviewed by the police department and safety commission of the location and safety measures proposed to be taken by the applicant. Permit applications shall be filed at least fourteen (14) days prior to the date of the sale activity, together with payment of the permit fee provided in section 3-1-6 of this code. Applications shall contain information as to the date, time and location of the activity and measures to be taken to ensure the safety of the participants, and shall be accompanied by a valid certificate of liability insurance with an approved insurer naming the village, its officials, representatives and employees as additional insureds and, by an executed agreement, to hold harmless and indemnify the village for injuries or losses sustained as a result of such activity. The village manager shall establish such restrictions or limitations as he deems appropriate in the issuance of the special permit to conduct the subject activity. (Ord. 2108, 4-3-1995)
