8-2-8: REPAIR OF STREET AND SIDEWALK OPENINGS:
All excavations under streets, pavements or sidewalks shall be filled with crushed limestone aggregate material approved by the public works director. Such filling materials shall be compacted in layers not exceeding twelve inches (12") in thickness. Original excavated materials shall be removed by the permittee. Sidewalks shall be replaced in accordance with section 8-3-3 through 8-3-7 of this title. Driveway aprons shall be replaced in accordance with sections 8-4-3 through 8-4-5 of this title. Pavement sections shall be replaced with a repair section consisting of an eight inch (8") slab of concrete (3,500 psi 28 day strength minimum). For roads with an asphalt wearing course, the concrete patch shall be overlain with four inches (4") of asphaltic concrete of a mix design acceptable to the director of public works. The asphaltic concrete shall be placed in two (2) lifts. Each lift shall be compacted. The depth of the concrete patch and the thickness of the asphaltic concrete shall be adjusted to provide for a final pavement elevation one-fourth inch (1/4") above ordained grade. The repairs shall be complete within fourteen (14) days of the excavation date. If the excavation takes place during the period of time that asphalt concrete is seasonally unavailable, a temporary wearing course will be installed consisting of a cold mixed asphaltic material. The maintenance of this temporary wearing surface is the responsibility of the permittee. The final repair will be accomplished not later than the following May 15. Concrete portions of the street repairs must be accomplished regardless of climatic conditions. Provisions for cold weather placement of concrete acceptable to the director of public works will be used as required. Placement of concrete for repair of sidewalks and aprons when average daily temperature is below forty degrees Fahrenheit (40°F) is not mandatory. These repairs will be complete by the following May 15. The permittee shall maintain a safe temporary sidewalk surface until final repairs are complete.
Alternatively, if the contractor does not have the means or methods to accomplish the work required to repair the street or sidewalk, the director of public works shall complete the final repairs and bill the contractor on a time and materials basis to be determined annually by the village. The contractor will not be alleviated of the responsibility to secure the site until the final repair is accomplished. (Ord. 2605, 1-22-2007)
