(A) Construction Fencing: If a permit required by this chapter authorizes demolition or authorizes the construction of a new principal structure, or addition, or other activity that includes construction within ten feet (10') of public trees, the applicant shall cause fencing to be installed around every tree located on public property abutting the subject property. Such tree fencing shall be installed under the drip line of the tree or in a location approved by the village forester, director of public works or their representative, not less than one day before start of any work and shall be continuously maintained until the end of all construction. Such tree fencing shall be chainlink, a minimum of seventy-two inches (72") in height and post driven, or construction snow/safety barrier fence, constructed of orange or brightly-colored plastic or vinyl material, a minimum of forty-eight inches (48") in height. Such fencing may be required on both public and private property, as follows:
1. If the tree is located on public property and its drip line extends onto the subject private property, fencing shall be installed along the whole drip line of the tree on both public and private property. See figure 1 attached to ordinance 2497.
2. If the tree is located on public property between the sidewalk and street curb, and its drip line extends beyond the sidewalk and beyond the street curb, such tree shall have fencing installed along the drip line, along the street curb and along both sides of the sidewalk. See figure 2 attached to ordinance 2497.
3. If the tree is located on public property and its drip line extends over the subject private property and abutting private property, fencing shall be installed along the drip line on both public and subject private property and along the border of the abutting private property. See figure 3 attached to ordinance 2497.
4. If the tree is located on subject private property or abutting private property and its drip line does not extend over public property, fencing is recommended along the drip line. See figure 4 attached to ordinance 2497.
During construction, no excess soil, additional fill, equipment, liquids or construction debris shall be placed within the drip line of any tree that is required to be preserved in its present location. The village forester or director of public works or their representative must approve the installation of the fence.
(B) Driveway Replacement: No alternative tree protection measures are required if the replacement driveway is installed using similar material and existing subgrade and is in the previous driveway footprint. Fencing is encouraged; the village forester or director of public works is available for consultation. Storage of materials within the tree drip line is prohibited. If new subgrade is installed, it must be in compliance with subsection 8-4-3(D) of this code.
